In this case, the United States Court of Appeals for the Fifth Circuit reviewed an appeal by Carolyn Johnson, an African-American female who worked at Louisiana State University Health Sciences Center (LSUHSC) as an Administrative Coordinator. Johnson alleged that she experienced sexual and racial harassment as well as retaliation from her former employer, LSUHSC. The harassment claims were based on a specific incident involving a colleague, Dr. Jeffrey Schumacher, slapping her on the buttocks, as well as several other instances of inappropriate behavior by Schumacher in the months preceding this incident. After reporting the conduct to her supervisor and Human Resources, Johnson was temporarily relocated to a different workspace while an investigation was conducted. Johnson claimed this relocation was in retaliation for her reporting the harassment.The court affirmed the district court's summary judgment in favor of LSUHSC on all counts. Regarding the harassment claims, the court found that while Johnson had sufficiently demonstrated that she was the victim of uninvited sexual and racial harassment, she failed to show that LSUHSC knew or should have known of the harassment and failed to take prompt remedial action. The court determined that LSUHSC took action to separate Johnson and Schumacher in response to Johnson's complaint and began an investigation into the matter, which was ultimately substantiated.In terms of the retaliation claim, the court found that Johnson failed to demonstrate that LSUHSC's decision to relocate her was a pretext for retaliation. The court noted that LSUHSC provided a legitimate, non-retaliatory reason for her relocation, which was to separate Johnson and Schumacher during the investigation. Johnson did not present evidence to suggest that this reason was pretextual. Therefore, the court affirmed summary judgment on Johnson’s retaliation claim. View "Johnson v. In this class action case, Nicole DeMarinis and Kelly Patire, current and former employees of Heritage Bank of Commerce, brought a case under the California Private Attorneys General Act of 2004 (PAGA) against Heritage Bank for wage and hour and other Labor Code violations. The Court of Appeal of the State of California First Appellate District Division Three affirmed the trial court’s decision, rejecting Heritage Bank’s argument to compel arbitration of plaintiffs’ individual PAGA claims based on a waiver in their arbitration agreement.In the agreement, the plaintiffs had waived their right to bring any claims against each other in any class or representative proceeding. The bank argued that the denial of arbitration was erroneous because the waiver provision was enforceable, pertaining only to plaintiffs’ nonindividual PAGA claims. The court, however, found that the provision violated public policy as it required plaintiffs to completely abandon their right to bring both individual and nonindividual PAGA claims in any forum.The court also found that the waiver provision's nonseverability clause and a "poison pill" provision, which stated that if the waiver provision is found unenforceable, then the entire arbitration agreement is null and void, precluded severance of the unenforceable nonindividual PAGA claims waiver. Consequently, the court concluded that the unenforceability of the waiver provision rendered the entire arbitration agreement null and void, thereby affirming the trial court's decision denying the motion to compel arbitration. The case concerned a lawsuit brought by Ariana Miles against her former employer, Kirkland's Stores Inc., alleging that two of the company's employee policies violated California law. The first policy required employees to take rest breaks on store property, while the second necessitated employees to undergo bag checks when they finished their shifts. Miles sought class certification for subclasses of employees affected by these two policies from May 2014 to the present. The United States Court of Appeals for the Ninth Circuit reversed the district court's denial of class certification for subclasses related to the Rest Break Claim due to the inaccuracy of the district court's finding that the rest break policy was inconsistently applied. The court held that overwhelming record evidence indicated that the company consistently enforced its rest break policy across all employees. However, the court upheld the district court's denial of class certification for the Bag Check Claim, as the evidence suggested that the bag check policy was sporadically enforced, which would require individualized inquiries. The United States Court of Appeals for the Ninth Circuit affirmed the decision of the District Court, which denied attorneys' fees and nontaxable costs under the Equal Access to Justice Act (EAJA) to the defendants-appellants, Brian Bowers, Dexter Kubota, and Bowers + Kubota Consulting, Inc. The Department of Labor had alleged that the defendants sold their company to an employee stock ownership plan (ESOP) at an inflated value. The government's case relied on a single valuation expert, whose opinion was ultimately rejected by the District Court, resulting in the government losing the case. Nonetheless, the District Court found that the government's litigation position was "substantially justified." On appeal, the Ninth Circuit held that the District Court did not abuse its discretion in concluding that the government's position at trial was substantially justified, and thus, in denying attorneys' fees and nontaxable costs under EAJA. The Court also held that the District Court abused its discretion in reducing the award of taxable costs, as it was based on a clearly erroneous finding of fact. This case involves a dispute between Griggs & Browne Pest Control Co., Inc. (plaintiff), and its former employee, Brian Walls (defendant). Upon hiring Walls in 2011, the parties entered into a noncompetition agreement, which was updated in 2020. The agreement stipulated that, in return for his training and access to the company's client list, Walls would refrain from soliciting business from or performing services for the company's current or former customers for 24 months after ending his employment with the company.In 2021, the company introduced a new policy requiring all employees to receive the COVID-19 vaccination or terminate their employment. Walls vocally opposed the policy and was told he could no longer resume his employment. A month later, the company discovered that Walls was contacting their former clients and performing pest-control services for them, in violation of the noncompetition agreement. The company initiated a lawsuit to prevent Walls from further violating the agreement.The Superior Court of Rhode Island granted a preliminary injunction in favor of the plaintiff, which Walls appealed. The Supreme Court of Rhode Island affirmed the lower court's decision, determining that the noncompetition agreement was valid and enforceable. The court rejected Walls' argument that he had been improperly terminated due to his refusal to receive the COVID-19 vaccine, noting that the circumstances surrounding his departure were immaterial to the enforcement of the noncompetition agreement. The court also found that the plaintiff would suffer irreparable harm due to loss of customer goodwill if Walls were allowed to continue servicing the company's clients. The balance of equities favored the plaintiff, and the injunction was necessary to uphold the status quo. In the case involving the Restaurant Law Center and the New York State Restaurant Association against the City of New York and the Commissioner of the City’s Department of Consumer and Worker Protection, the plaintiffs challenged a New York City law prohibiting the wrongful discharge of fast-food restaurant employees. In a workers' compensation case, an employee was injured and sought compensation from her employer and its insurance carrier. The employee failed to provide her expert witness's evidence in a timely manner, serving them only two weeks before the arbitration hearing began. The employer and its insurance carrier objected, arguing that this late submission of evidence was unfairly prejudicial. The deputy workers’ compensation commissioner agreed with the employer and excluded the evidence. This decision was affirmed by the commissioner, but was later reversed on judicial review by the district court. The court of appeals affirmed the district court’s ruling. However, the Supreme Court of Iowa held that the commissioner’s decision to exclude untimely evidence was entitled to deference. The court found that the commissioner did not abuse his discretion by excluding the untimely evidence since the employee had disregarded multiple deadlines and submitted the reports only about two weeks before the hearing. Moreover, the reports were not from the employee’s treating physicians and the vocational report reached a conclusion that no other expert in the case shared. Therefore, the supreme court vacated the court of appeals decision, reversed the district court decision, and remanded the case back to the district court to enter a judgment affirming the commissioner's decision to exclude the untimely evidence. In this California case, Gary Garner, the plaintiff, filed a wrongful death lawsuit against BNSF Railway Company, alleging that his father's exposure to toxic levels of diesel exhaust during his four-decade employment with BNSF caused his father's non-Hodgkin's lymphoma and subsequent death. Garner retained several experts to opine on whether diesel exhaust and its constituents are capable of causing cancer, including non-Hodgkin's lymphoma, and whether the father's workplace exposure to diesel exhaust was a cause of his cancer. However, the trial court granted BNSF's motions in limine to exclude Garner's three causation experts from trial. The trial court found that the science the experts relied on was inadequate and there was too great an analytical gap between the data and their opinions. As a result, Garner's wrongful death lawsuit was dismissed before trial.Garner appealed the trial court's decision. The Court of Appeal, Fourth Appellate District, Division One, State of California, concluded that the trial court erred in excluding Garner's experts. The court held that the trial court's gatekeeping role is not to choose between competing expert opinions, and it does not involve weighing the persuasiveness of an expert's opinion, substituting its own opinion for the expert’s opinion, or resolving scientific controversies. The court found that Garner's experts used their scientific judgment and expertise to evaluate the available data and determine whether to draw an inference of causation, which is a matter of informed judgment, not scientific methodology. The court reversed the orders and judgment and remanded the case to the trial court with instructions to enter new orders denying BNSF's motions in limine. View "Garner v. Plaintiff-Appellant Joseph Brent Mattingly, an employee of R.J. Corman Railroad Services, LLC (“Corman Services”), suffered injuries while repairing a bridge owned and operated by Memphis Line Railroad (“Memphis Line”). Mattingly filed a lawsuit seeking recovery under the Federal Employers’ Liability Act (“FELA”), which covers employees of common carriers by railroad. The U.S. District Court for the Eastern District of Kentucky granted summary judgment in favor of the defendants, ruling that Mattingly was not employed by a common carrier, a prerequisite for FELA coverage.On appeal, the U.S. Court of Appeals for the Sixth Circuit affirmed the lower court's decision. The appellate court rejected Mattingly’s argument that Corman Services, his employer, was a common carrier because it was part of a “unitary” railroad system managed by Corman Group. The court held that Corman Services' bridge repair and construction services did not provide an inextricable function for Memphis Line’s common carrier services and thus, did not qualify as a common carrier under FELA. The court further rejected Mattingly’s assertion that he was a “subservant” of a common carrier. The court found that Mattingly failed to demonstrate that Memphis Line, a common carrier, controlled or had the right to control the daily operations of Corman Services, as required to establish a master-servant relationship under common law.The court also held that Mattingly's claims regarding discovery issues were unpreserved for appeal, as he did not adequately inform the district court of his need for discovery in compliance with Federal Rule of Civil Procedure 56(d). In the case before the United States Court of Appeals for the Fourth Circuit, Gregory Kelly, the former Town Manager of Abingdon, Virginia, sued the Town for discrimination, retaliation, interference, and failure to accommodate under the Americans with Disabilities Act (ADA). Kelly alleged that he suffers from anxiety, depression, and high blood pressure, and these conditions worsened due to a hostile work environment created by the elected Mayor and Town Council. He further alleged that, despite his efforts to seek accommodations for his disabilities, the Town failed to engage in a meaningful dialogue to determine appropriate accommodations, and instead escalated its pattern of harassment.The Court of Appeals affirmed the lower court's dismissal of Kelly's discrimination and interference claims, along with its ruling that a letter Kelly sent to the Town in January 2018 was not an ADA accommodation request. The court reasoned that although Kelly had informed the Town of his disabilities and it was aware of them, the January 2018 letter, despite being titled "Accommodations Requests," did not make it clear that Kelly was seeking accommodations for his disabilities. The requests in the letter were not connected to Kelly's disabilities and were more related to general workplace issues. Therefore, the letter did not trigger the Town's duty to engage in an interactive process to determine appropriate accommodations under the ADA.The Court also found that Kelly failed to state a claim for ADA discrimination. He did not provide any facts suggesting that the Town had a discriminatory motive or that his disability was a "but-for" cause of his constructive discharge. The Court further held that Kelly failed to state a claim for ADA interference, as he did not allege that the Town engaged in behavior to prevent him from exercising his ADA rights or that the Town had a discriminatory motive.
